These terms govern your access to and use of FinStitch. By creating an account or using the product, you agree to be bound by them. Please read them carefully.
1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the FinStitch website, applications, APIs and related services (the “Services”), provided by FinStitch Limited(“FinStitch”, “we”, “our” or “us”). By creating an account, accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree, you must not use the Services.
Your use of the Services is also subject to our Privacy Policy, Cookie Policy, Security page and GDPR & Your Rights page, which form part of your agreement with us.
2. About FinStitch
The Services are provided by FinStitch Limited, a company registered in England & Wales (company number 17242791). FinStitch is a personal finance platform designed to help you understand and manage your financial life in one place. Depending on your location, connected institutions and available integrations, the Services may include:
- Net worth tracking and reporting.
- Investment portfolio tracking and performance analytics.
- Bank account aggregation through regulated Open Banking providers.
- Investment-account connectivity through supported financial institutions.
- Asset allocation analysis and cash-flow monitoring.
- Financial goal tracking and planning tools.
- Other financial-management features we may introduce from time to time.
3. Eligibility
To use FinStitch, you must be at least 18 years of age, have the legal capacity to enter into a binding agreement, and use the Services only where they are lawfully available. You agree to provide accurate, complete registration information and to keep it up to date, and you are responsible for ensuring your use complies with the laws of your jurisdiction.
4. Your account
To access certain features you must create a FinStitch account. You agree to keep your login credentials confidential (we strongly recommend enabling multi-factor authentication), to notify us promptly if you suspect unauthorised access, and to accept responsibility for all activity under your account. You must not share your account with anyone else. We may suspend or terminate accounts that violate these Terms or compromise the security of the Services.
5. Connecting financial accounts
FinStitch lets you connect eligible financial accounts through supported third-party providers. By connecting an account, you authorise FinStitch to retrieve and process the financial information you consent to share. You acknowledge that you remain responsible for your relationships with your financial institutions, that access depends on third-party systems outside our control, and that institutions may change or withdraw access at any time — which may make some features unavailable. When using regulated Open Banking connections, FinStitch never asks for or stores your online banking credentials.
6. Financial information
Information displayed through the Services is provided for informational purposes only. While we strive to present accurate and timely information, we cannot guarantee that data obtained from third parties is always complete, accurate or up to date. You remain responsible for verifying your financial information before making any decisions.
7. No financial advice
FinStitch is a decision-support tool, not a regulated financial adviser, broker or bank. It provides financial organisation tools, analytics, reporting and general insights. We do not provide personalised financial, investment, tax, legal, accounting or retirement advice, or recommendations to buy, sell or hold any financial product. Any insights, projections, analytics or calculations are for information only and are not a substitute for professional advice. You remain solely responsible for your financial decisions.
8. Acceptable use
You agree that you will not:
- Use the Services for any unlawful purpose.
- Attempt to gain unauthorised access to our systems, or interfere with their operation or security.
- Introduce malware or malicious code.
- Reverse engineer, decompile or exploit the Services, except where permitted by law.
- Use automated tools to scrape or extract data without our permission.
- Impersonate any person or organisation, or misrepresent your identity.
- Infringe the rights of others, or use the Services in a way that could harm our platform or other users.
9. Availability of the Services
We aim to provide a reliable and secure service, but we do not guarantee that the Services will always be available, uninterrupted or error-free. The Services may be affected by planned or emergency maintenance, security updates, technical issues, network or internet failures, financial-institution or Open Banking provider outages, cybersecurity incidents, or events outside our reasonable control. We may modify, suspend or discontinue any feature at any time, and may temporarily suspend access where necessary to protect users, maintain security or comply with the law.
10. Intellectual property
Unless otherwise stated, the Services and all associated intellectual property — including the FinStitch name, branding, logos, software, source code, APIs, user interface, design, databases, graphics, documentation and content — are owned by or licensed to FinStitch Limited and protected by applicable laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your personal, non-commercial use. You may not copy, modify, create derivative works from, reverse engineer, redistribute or resell the Services (except as permitted by law), remove proprietary notices, or use FinStitch branding without our prior written permission.
11. User content
You retain ownership of the information you submit to FinStitch, including manually entered financial information, notes and goals. By submitting content, you grant FinStitch a limited licence to store, process and display it solely to operate and improve the Services. You represent that you own or have the rights to the content, that it does not infringe the rights of others, and that it complies with applicable law. You remain solely responsible for the content you provide.
12. Fees and paid services
Some features may be offered free of charge, while others may require a paid subscription. If you subscribe to a paid plan, pricing will be shown clearly before purchase, fees are charged in advance unless stated otherwise, taxes may apply, and renewal and cancellation details will be presented before payment. Unless required by applicable law, subscription fees are non-refundable. Nothing in these Terms affects your statutory rights under consumer protection law.
13. Third-party services
FinStitch integrates with third-party financial institutions and service providers, which operate independently of us. We are not responsible for the availability or accuracy of third-party services, changes made by financial institutions, interruptions they cause, or their terms and privacy practices. Your use of third-party services may also be subject to separate agreements with those providers.
14. Disclaimers
To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis, and FinStitch disclaims all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee continuous availability, that financial information will always be complete or accurate, that third-party integrations will remain available, or that projections will prove accurate. Financial markets involve risk, and past performance does not guarantee future results.
15. Limitation of liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot legally be excluded. Subject to that, FinStitch is not liable for indirect or consequential losses, loss of profits, investment opportunities, business, anticipated savings or goodwill, data loss caused by third-party providers, or financial decisions you make based on the Services.
To the maximum extent permitted by law, FinStitch's total aggregate liability arising out of or relating to the Services shall not exceed the total amount you paid us during the twelve (12) months before the event giving rise to the claim. If you have not paid for the Services, our liability is limited to the minimum amount required by applicable law.
16. Indemnity
You agree to indemnify and hold harmless FinStitch Limited, its directors, officers, employees, contractors and affiliates from any claims, liabilities, damages, losses and expenses arising from your misuse of the Services, your breach of these Terms, your violation of applicable laws, or your infringement of any third party's rights.
17. Suspension and termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access if you breach these Terms, if your use presents a security risk, if we are required to by law, or if we reasonably suspect fraudulent or unlawful activity. Termination does not affect rights or obligations accrued beforehand, and provisions relating to intellectual property, liability, indemnity and governing law survive termination.
18. Changes to the Services
We continuously improve FinStitch and may introduce, modify or remove features, change supported institutions, improve security and update integrations. Where practicable, we will give reasonable notice of material changes that significantly affect your use of the Services.
19. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “last updated” date above and, where required by law, provide appropriate notice. Your continued use of the Services after the effective date constitutes acceptance of the changes.
20. Governing law
These Terms are governed by and interpreted in accordance with the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws provide otherwise.
21. Severability & waiver
If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions continue in full force and effect. Our failure to enforce any provision is not a waiver of that provision or any other rights.
22. Entire agreement
These Terms, together with our Privacy Policy, Cookie Policy, Security page, GDPR & Your Rights page and any additional policies referenced here, constitute the entire agreement between you and FinStitch regarding your use of the Services.
